Welcome to Actualis. These Terms of Service (“Terms”) govern your access to and use of the Actualis website, subscription service, and any personalized program content generated through it (collectively, the “Service”), operated by Actualis LLC (“Actualis,” “we,” “us,” or “our”).
By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use Actualis. By using the Service, you confirm that you meet this requirement.
2. Description of the Service
Actualis provides a self-guided personal development framework rooted in humanistic psychology. Subscribers complete a survey about challenges related to self-identity and self-improvement, and receive an AI-generated personalized program intended to support their own reflection and habit-building.
Actualis is an educational and self-guided tool. It is not therapy, counseling, medical treatment, or a substitute for professional mental health care. See Section 3 below.
3. Not Therapy, Not Medical Advice
Actualis is not a licensed therapist, psychologist, psychiatrist, medical provider, or counselor, and nothing provided through the Service constitutes therapy, diagnosis, treatment, or professional mental health advice of any kind.
The personalized programs are generated by artificial intelligence based on information you provide. They are intended as a general self-reflection and habit-building tool, not as clinical guidance.
If you are experiencing a mental health crisis, thoughts of self-harm, or need professional support, please contact a licensed mental health professional or, in the United States, call or text 988 (Suicide & Crisis Lifeline), or your local emergency services.
Use of Actualis does not create a therapist-client, doctor-patient, or any other professional relationship between you and Actualis.
4. Accounts and Subscriptions
• You must provide accurate information when creating an account and keep your login credentials secure.
• Actualis offers a paid monthly subscription. Current pricing is displayed on our website at the time of purchase.
• Subscriptions automatically renew each billing period until cancelled. You may cancel at any time through your account’s subscription management portal; cancellation takes effect at the end of the current billing period.
• Refunds: Because a personalized program is generated shortly after subscribing, subscription fees are generally non-refundable once a program has been generated for that billing period. If you believe you were charged in error, contact us at [SUPPORT EMAIL] and we will review the request.
5. Your Content
You retain ownership of the information you submit through the survey (“Your Content”). By submitting Your Content, you grant Actualis a license to use it solely to generate your personalized program and operate the Service, including transmitting relevant portions to third-party AI providers as described in our Privacy Policy.
You agree not to submit Your Content that is unlawful, abusive, or that impersonates another person.
6. AI-Generated Content
Personalized programs are generated using artificial intelligence based on the information you provide. While we design the system to produce relevant and thoughtful output, we do not guarantee the accuracy, completeness, or suitability of any AI-generated content for your specific circumstances. You are solely responsible for decisions you make based on content received through the Service.
7. Intellectual Property
All content on the Actualis website — including text, design, branding, and the Actualis framework itself — is owned by Actualis or its licensors and protected by intellectual property law. Your personalized program is provided for your personal, non-commercial use; you may not resell, redistribute, or publicly republish it without our permission.
8. Prohibited Conduct
You agree not to:
• Use the Service for any unlawful purpose
• Attempt to access another user’s account or data
• Interfere with or disrupt the Service’s operation
• Reverse-engineer, scrape, or attempt to extract the underlying prompts or systems behind the Service
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTCOME OR RESULT WILL BE ACHIEVED FROM USING IT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACTUALIS LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO ACTUALIS IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Actualis LLC from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.
12. Termination
We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms. You may stop using the Service and cancel your subscription at any time.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the website or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Michigan.
